ALL FOR PADEL SL (hereinafter, AFP) with address at Calle Cardenal Marcelo Spínola, 42 - PLT 2, Madrid, 28016 (Madrid), registered in the Mercantile Registry of Madrid, volume 29046, book 0, folio 162, section 8 , sheet m-529300, with NIF B86333465, in its capacity as service provider, is responsible for the websitewww.allforpadel.comand, in particular, ofshop.https://allforpadel.com/en/(hereinafter, we will refer to these together as the website).

These Purchase Conditions establish the conditions for sales made between any natural person who wishes to make a purchase of products on the website (hereinafter, the Client) and AFP.
AFP reserves the right to unilaterally modify these Purchase Conditions, the changes being applicable to orders placed on or after their effective date.

Placing an order with AFP implies acceptance by the Client of these Purchase Conditions and the Privacy Policy.

Hiring procedure
In accordance with article 27 of “Law 34/2002, on Services of the Information Society and Electronic Commerce” (hereinafter, LSSICE), the contracting procedure will follow the following steps:

1. Products offered
The main characteristics of each product are described in their corresponding sheets or sections (characteristics, price, offers, discounts, etc.).
The description of the products offered on the website is made based on the information provided by the AFP providers.

2. Price and validity period of the offer.
The prices applicable to each product are those published on the website, are expressed in euros and include Value Added Tax (VAT) or other taxes that may be applicable. The applicable VAT rate will be the one legally in force at all times depending on the specific article in question.

The prices of the products, unless expressly stated otherwise, do not include shipping, handling, packaging, shipping insurance or any other additional service attached to the product purchased.

Prices may change daily, at any time, such changes will not affect orders previously confirmed by AFP to the Client.

3. Formalization of orders
Orders can only be made by natural persons who register on the website, who will hold the status of consumer for the purposes of the applicable regulations.

AFP will not accept orders made by companies, associations, independent contractors or any other type of legal person, who must contact AFP through the commercial channels established for legal persons.

To be able to buy on the website you must:
• Provide your name and address, telephone number, email address, payment information and other information that is required
• Be at least 18 years old
• Register and create a Client account, through the website.

For registration purposes, the Client will indicate an email and enter a password, committing to make diligent use of them and not to make them available to third parties, since they are personally responsible for each purchase made with their user identification and password. AFP undertakes to treat the data confidentially, in accordance with thePrivacy Policyand theCookies policyof this website.

The Customer agrees that his order is an offer to buy the Products listed in his order, in accordance with these Conditions.

Before placing the order and proceeding to payment, the Customer can check all the details of the order: items, quantities, price, availability, transport costs, charges, discounts, taxes and the total purchase.

After receiving the order, AFP will send an order confirmation to the Client by email, with the details of the purchase made. The conclusion of the contract will take place at the moment in which the Client receives said confirmation.

The order confirmation email constitutes the Customer's proof of purchase, AFP will file it in accordance with the requirements of article 27 of the LSSICE.

All orders are subject to product availability. AFP has a period of 3 days from the formalization of the order for review and acceptance. In the event that the product desired by the Client is not available, AFP may reject the order and cancel it. AFP may decide, at its sole discretion, not to accept orders that it considers abnormal, that it suspects to be fraudulent or that have not been placed by natural persons.

The Client can check the status of his order and the history of orders, in the "MY ACCOUNT" section, by logging in with his access data. For any additional information about the order, the Client may contact the AFP Customer Service (contact in article 14 of this document)

The Client is responsible for the accuracy and veracity of the information provided to AFP.

4. Rectification, cancellation or modification of orders.
The Customer may correct errors related to the personal data provided in their order, after the payment process, by contacting AFP Customer Service (contact in article 14 of this document)

AFP does not guarantee to be able to carry out changes or modifications to the orders. The Customer must contact the Customer Service Department (contact in article 14 of this document) as soon as possible to communicate any incident with their order, which entails the cancellation and/or modification of the order. AFP will try to attend to the requested changes, provided that the client communicates it within 24 hours after placing the order and that the communication takes place before the order preparation phase.

5. Delivery of orders
AFP only makes shipments in Spain and with the restrictions indicated below:

Deliveries are not made in:
• PO Boxes
• Andorra, Canary Islands, Ceuta, Melilla.

Consumers in Andorra, the Canary Islands, Ceuta and Melilla can contact the Customer Service Department to find out how they can access the products marketed by AFP.

AFP undertakes to deliver the product to the address indicated by the Client when placing the order, and it is possible for the same order to be divided into several deliveries.

AFP will not assume any responsibility when the delivery of the product cannot be made due to: i) incurring in one of the indicated restrictions; ii) the data provided by the Client is false, inaccurate or incomplete or iii) any other cause beyond the control of AFP.

The shipment of orders will be made through a courier service. The dates or delivery times will be understood as approximate, and the delay will not constitute a fundamental breach of this contract. The delivery time will be indicated in the order confirmation email sent by AFP.

The delivery period shall not exceed 30 days from the conclusion of the contract. If the Client does not receive the order within said period, he will have the right to request delivery to AFP, granting us a new reasonable delivery period or he may terminate the contract and will have the right to be reimbursed for all the amounts he has paid. If the Customer places an order for personalized product(s), the manufacturing time for said Product(s) will be added to the delivery time.

After 7 working days from the notification to the Client of the attempted delivery of the order, without the order being delivered and being returned to AFP, for reasons beyond its control, we will consider that the Client withdraws from the contract, considering it resolved. As a result of the termination of the contract, we will refund the price of the product, within a maximum period of 14 days from the date of termination. Please, keep in mind that the transport derived from the resolution may have an additional cost, being authorized to pass on said cost to the Clients.

It is up to the Customer to verify the condition of the products at the time of receiving the order and to expose in the document of reception of the delivery all the observations that may be justified. Please review the order received, check its status and verify that it is complete. In case of damage or missing product, please contact AFP Customer Service as soon as possible (contact in article 14 of this document).

6. Right of withdrawal
The Customer has a period of 14 calendar days, counted from the date of receipt of the product, to exercise their right of withdrawal. In the case of an order received in several deliveries, the right of withdrawal will expire within 14 days from the date you received the last delivery.

The Client may only return the product that has been subject to reasonable care on his part and that has not been used in a manner other than that which is necessary to verify its nature and characteristics. In accordance with current legislation, the Client will be responsible for any decrease in the value of the product derived from a use other than that.

In addition, in accordance with the applicable regulations, the right of withdrawal has different exceptions and the Client may not exercise it with respect to:

- Products made according to the specifications of the consumer and user or clearly personalized...

- Sealed products that are not suitable to be returned for reasons of health protection or hygiene and that have been unsealed after delivery.

Exercise of the right of withdrawal
The right of withdrawal must be exercised within the period of 14 calendar days indicated.

The Client may exercise their right of withdrawal by communicating it to AFP, through a statement that expresses it, in an unequivocal manner, addressed to AFP's Customer Service, by any of the following means:

Likewise, the Client may use the withdrawal form that we make available to them.

Once we have received your communication or thewithdrawal formcompleted, AFP will acknowledge receipt and send you a confirmation email.
The Client, then, must return the product, without any unjustified delay and, in any case, no later than 14 calendar days, counting from the date on which he notified his decision to withdraw from the contract.

AFP informs that the direct costs of returning the goods (shipping costs) will be borne by the Client, in accordance with the applicable regulations.

Customer must include all accessories, user manuals, and any free gifts found in the same product package. In the case of a Product purchased as part of a set of multiple products, all Products that are part of the set must be returned. Please treat the product with reasonable care and pack it securely.

AFP will reimburse the Client for the amounts paid by the Client, within a period of 14 calendar days, from the date on which we have received your message revoking the contract and subject to the circumstances set forth below. We may refuse to refund payment until we have received the merchandise back or until you prove that you have shipped the merchandise, whichever comes first.

The refund will be confirmed by email and we use the same means of payment as the one used by the Client for the original transaction, unless something different has been expressly agreed with you. In no case do we charge a fee for the refund of the payment.

We inform you that, in accordance with current legislation, AFP will only reimburse the amount of shipping costs corresponding to the least expensive method of ordinary delivery and not those derived from a different delivery selection made by the Client.

AFP reserves the right to refuse the return of the Product if the Client intends to exercise the right of withdrawal with respect to a product for which it is not possible to exercise it.

Likewise, the consumer is responsible for any depreciation of a product that results from manipulations that are not necessary to determine the nature or characteristics of the product, without being deprived of his right of withdrawal. AFP reserves the right to deduct from the amount to be reimbursed the decrease in value suffered by the Product, when the Product returned by the Client: i) is damaged, ii) has been used in a manner other than that which is necessary to verify the nature and characteristics of the product, iii) is incomplete or iv) that has not been treated with reasonable care during the time it has been in your possession and/or when it is returned.

7. Claims and out-of-court dispute resolution mechanisms
The Client may make any claim they deem appropriate, through any written means of contacting AFP's Customer Service, and it will be dealt with as soon as possible, within a maximum period of 1 month from receipt.

7.1. Complaint sheets from the consumer authority
AFP informs the Client that it makes claim forms available to them, which they may request by contacting the Customer Service Department. Once requested, AFP will send you the official form or provide you with access to it.

7.2. Online Dispute Resolution (ODR)
In accordance with art. 14.1 of the “Regulation (EU) 524/2013 on online dispute resolution in consumer matters”, we inform you that the European Commission provides a free access platform for online dispute resolution, through the intervention of a third party, called “ Online dispute resolution body” (hereinafter, ODR) and that acts as an intermediary between the parties in conflict. This body is neutral and will dialogue with both parties to reach an agreement, being able to finally suggest and/or impose a solution to the conflict.

8. Force majeure
The parties -AFP and the Client- will not incur any responsibility for any lack of compliance due to force majeure. For these purposes, "force majeure" is understood as any fortuitous event resulting from an event that is unpredictable.

In these cases, the fulfillment of the obligation will be delayed until the cause of force majeure ceases, without this deriving any responsibility from the contracting party affected by the cause of force majeure, nor any right to compensation in favor of the other. part.

9. Competition
The Client may not assign, transfer or transmit the rights, responsibilities and obligations acquired with the purchase.
10. Language
Contractual and commercial information and communications with the Client will be made in Spanish or English, depending on the language selected by the Client.

11. Shipping costs
The prices do not include shipping or communication costs, or installation costs, or additional services.

Shipping costs are variable depending on the weight of the items and the destination. Shipping costs can be found at any time from the shopping cart before making the purchase.

12. Payment method
Any payment made to AFP entails the issuance of a simplified invoice in the name of the Client or the company name that he has informed at the time of placing the order. AFP will issue an invoice, upon request by the Client through the Customer Service Department and provided that said operation is in accordance with the applicable regulations.

The simplified invoice will be sent together with the purchased product, as well as in PDF to the email address provided by the Client.

AFP makes the following payment methods available to the Client:

Bank card (credit or debit):If you choose to pay by card, the Customer's order will not be processed until the payment has been authorized by your bank or cashier. For security reasons, AFP verifies all orders paid by bank card.

PayPal:The Client will be able to pay quickly and securely with his PayPal account, which is a service provided by PayPal (Europe) S.à rl et Cie, SCA (“PayPal”). AFP will not pass on the commission set by this means of payment to the client.

The contracting of the services offered by AFP on the website is carried out in a secure environment through the implementation of a "Secure Sockets Layers" (SSL) data encryption system that guarantees the protection of communications via the Internet. You can verify that you are in a secure operating environment by looking at the closed padlock at the top of your screen, next to your domain name.

If our security department detects any anomaly or suspicion of fraud, AFP reserves the right to cancel the transaction for security reasons.

It is our duty to inform you that no data related to bank accounts, card numbers or passwords will be stored on our servers, since this information is processed directly by the banking systems and is not stored anywhere outside the entity itself.

13. Applicable legal guarantee
AFP offers guarantees on the products that it sells through the website, in the legally established terms for each type of product and is therefore responsible for the lack of conformity of the products, provided that it is manifested within a period of two years from product delivery.

The product does not conform when: (i) it does not conform to the description made by AFP, (ii) it is not suitable for the uses to which it would ordinarily be destined or (iii) it does not present the usual quality and features that are expected from a product of the same type.

If any of the purchased products does not conform, the Client must notify AFP by contacting the Customer Service Department. The Client must report the problem and proceed to send the product, in accordance with the procedures indicated for the right of withdrawal, provided for in the sixth section of this document.

AFP will examine the returned product and notify the Customer by e-mail, within a reasonable period of time, if the refund is appropriate or, where appropriate, the repair or replacement of the product.
In no case will the reimbursement, replacement or repair of the Product have a cost for the Client.

The Client may choose to demand the repair or replacement of the product, unless one of these options is objectively impossible or disproportionate for AFP.

If the lack of conformity of the Product arises during the first 6 months, AFP will agree to the return of the Product or its replacement; whereas, if the lack of conformity appears after said period has elapsed, the product will be replaced or repaired without charge by AFP.

The Client must know that the legal guarantee does not cover any damage. Damages caused by inappropriate use or due to lack of or inappropriate care of the product, torsion, compression or dropping the product are excluded from the legal guarantee. The warranty does not cover any damage caused by abuse or improper use, replacement or maintenance as well as normal wear and tear.

The useful life of a product depends on the particular use made of it, the conditions of use and the characteristic wear patterns of the user. AFP will not replace products damaged by normal wear and tear or that have exceeded the useful life of the product.

• Refund
The refund will be made within 14 days from the date of the email communication of the refund or replacement of the non-conforming product. The amounts paid for those products that are returned because they are not compliant will be fully reimbursed to the Client, including the costs incurred by the Client to return it. In case of reimbursement, we will use the same means of payment as the one used by the Customer for the purchase, unless something different has been expressly agreed with you.

• Substitution
The replacement of the product will be made within 14 days from the date of the communication email of the replacement of the non-conforming product. AFP informs you that the replaced product does not have a new 2-year warranty term, but the remaining term that remains to be fulfilled is activated.

• Repair
The repair of the product will be carried out within 14 days from the date of the communication email of the repair.

These conditions will be governed or interpreted in accordance with Spanish legislation in what is not expressly established.

AFP and the Client agree to submit any controversy that may arise from the provision of services object of this contract to the jurisdiction of the Courts and Tribunals of the Client's domicile; if the Client is domiciled outside of Spain, AFP and the Client expressly waive any other forum, expressly submitting to the Courts and Tribunals of Madrid, in Spain.
